MALLORCAN REAL ESTATE PURCHASE CONDITIONS FOR RESIDENTS/NON RESIDENTS:

ALL foreigners within the EUROPEAN UNION OR from any other country MUST obtain a NIE number BEFORE or WHILE purchasing a property, business, car or boat/yacht in Spain. This number is merely a registration number that allows you to pay the proper taxes involved in the purchase, as well as do buisness and more. This number the "Numero de Identificación extranjero" or foreign identification number can be solicited for you by your agent, lawyer or designate, or if you wish to stand in a line for several hours then wait for several hours more inside the offices, you may solicit it yourself! You need to fill out a form , make two copies of it, two copies of your passport, you will need the name of your mother, her maiden name and your fathers name to fill out the form, as well as an address in SPAIN where they are to send your NIE number certificate. You or your designate MUST present the form and copies with your ORIGIAL PASSPORT!! OR a NOTARIZED COLOUR PHOTOCOPY.
ONCE your NIE is presented, it will take from 5 weeks to 3 months to obtain your number. I have help and contacts that could, in an emergency, obtain your NIE number faster.
RESIDENCE PERMITS are not needed live and work here. Once you have your NIE number, you then go to the CITY or TOWN HALL and get REGISTERED or "Empadronado" as they say in Spanish, and once registered with the town hall and your NIE in hand, you may work and live here legally. You may solicit a RESIDENCY PERMIT, you will still have to register with the town hall, but you can move around and live and work anywhere in Spain, altho with your NIE number, if you wish to move somewhere else, you only need to get registered at the Town Hall of your new place of residence.

The purchasing conditions for residents is very similar to that of non residents except that:
Residents can obtain up to and sometimes over 80 % bank financing.
Residents just like the local Spaniards, have a 25% discount on travel costs by air or by boat to the mainland of Spain.
Residents can vote in local elections and run for local office in their town hall districts.
In some cases, being a resident enables you to obtain commercial discounts in building supplies, furniture, fittings, appliances and other items - this of course depends on the company you are dealing with. My office can help you in this direction, as we can obtain and have obtained important discounts for clients who make large purchases etc.
Residents do not have to deposit a 5% fee of the selling price of their property to the notary when they sell their property.
Residents who own their property since before 31st of December 1989 and then sell it do not have to pay any capital gains tax.

Although in my advertising the correct ENGLISH translation of "Gestor Profesional Intermediario" is something akin to "Intermediate Lawyer" as translated by the A.P.I. group - The Spanish Association of Real Estate Agents, as was PUBLISHED by the A.P.I. association in the Majorca Daily Bulletin around 1987 to describe the title of "Gestor Profesional Intermediario", and even though during two years we studied Spanish notarial law and real estate law as well as real estate marketing in the Malaga Politecnic Institute, it does not mean under ANY circumstances that we are "full blown lawyers"! We can advise and counsel on the ins and outs of buying and selling property or businesses here in Mallorca and also act as a legal intermediary, but we do NOT and CANNOT replace a proper lawyer.
Our basic job is to find you the property that you want with the conditions that are more or less acceptable to you.
AFTER that step, it is highly recommended that you consult with a proper lawyer to obtain up-to-date advice on the latest taxes, laws and ways most advantageous to you when making your purchase.
The fees of the intermediary are NOT paid by you, but by the seller under current Spanish legislation OR unless agreed upon by all parties a different arrangement.
Although the costs of a proper lawyer are paid for by the BUYER, it is definitely money well spent, and can only serve to further guarantee the correctness of your purchase and the peace of mind that comes with knowing all was done properly, correcly, legally and your purchase is secure!
Such peace of mind has no price!
