You are visitor number: ================================= Generally speaking, when you purchase a real estate property, your purchase costs are as follows: The BUYER is responsible to pay for his/her lawyers fee, plus the deeds, the deed search, the notary and registry fees, the property transfer taxes which are currently at 7%. The PLUS VALUE TAX in the Balearics is usually paid for by the BUYER unless otherwise agreed upon which is seldom. The reasoning here is the property "jumps" in value at least 12% when the ink is dry on the deeds, and the new buyer will also benefit from the plus value INCREASE in the value of his property as time goes on. In the case of brand NEW properties from a builder, the VAT (I.V.A.) tax is 7%; plus the PLUS VALUE ( Town Hall ) tax (unless specified otherwise), and the bank valuation fees IF a bank loan is required. ================================ BANK LOANS: Residents and Spaniards can get from 50% to 80% financing when buying a first or main dwelling, the norm used to be 80% bank financing BASED ON THE BANK VALUATION OF THE PROPERTY, but with the current climate, banks prefer to make loans around the 50% to 70% range. IF your proof of income and delaration of your wealth is above the norm, chances are you will be able to get a higher mortgage. The bank valuation can be anywhere from 10 to 35% LOWER than the MARKET price or asking price of the property. NON RESIDENTS can get up to 60 or 70% Bank financing,, 80% can be obtained under special circumstances (your income and wealth), if you are offering greater solvency and capacity to pay back the loan. The buyer must then be aware that his purchase costs NOW INCLUDE the following: Paying for the bank valuation survey, a bank charge of 1% to 1.5% opening of the loan costs, the notary and registry and deeds costs for the loan and a 1% tax for the "Hacienda" of the loan amount plus all this ON TOP of the notary and registry costs for buying the property, plus the buyer could be liable to pay a 1% to 3% fee if he/she pays off the bank loan ahead of the contracted time. There is one bank in Palma that offers 2.75% mortgage interest DURING THE FIRST YEAR of the loan. After that it goes to a variable rate. ================================ OVERALL COSTS: IF you are paying CASH for the property and you do not need any bank FINANCE, your purchase costs then are limited to: 1) Notary. 2) Property Registry. 3) Spanish Tax Office...7% tax usually. IF the property is a FREEHOLD BUSINESS (Bar, Hotel, Premesis etc.) its 16% tax. 4) Town Hall Plus Value Tax where applicable.(Some country farms do NOT have any Plus Value tax.) 5) Documents and Judicial Acts (0.5%) In approximate terms, the above costs will represent a total of 9.8% of the declared purchase price on the deeds. PURCHASE WITH FINANCING: Apart from the costs mentioned above, if you purchase the property with a bank loan through a bank, you will need to add: 1A) Official Bank Valuation costs...vary considerably from one bank to the next. 1) 1% of the loan for the tax office. 2) Notary for the bank loan deeds/contract. 3) Registry for the bank loan contract/deeds to be added to the property registry. This can add another 1.2 to 1.5% to the purchase costs. Please understand that these figures are not exact and might fluctuate slightlty depending on the conditions of the sale, but for general calculation purposes, these figures are correct enough to give you a realistic idea of what the purchase costs will be. ==================================== REAL ESTATE AGENTS COMMISSION: In Spain this is paid for by the OWNER and NOT the seller unless agreed otherwise. This commission is subject to 16% VAT (I.V.A.) paid by the owner and also the owner retains 15% of the commission to deposit in the Hacienda ( Tax Office ) as partial payment of the agents INCOME TAX. The owner will need to extend a formal receipt for this after he gets the formal invoice from the agent. The above percentages may change with time and are strictly orientative. Please consult with a proper Spanish lawyer or Tax accountant/advisor for the latest update in that department! The commission is legally due to be paid once the buyer and the seller sign an option contract or purchase agreement, or at the very latest, it is paid at the notary after the purchase deeds are duly and properly signed. If an agreement is made to pay off the property over a long period of time, the commission in full is to be paid for in advance as the agent has completed his job - unless otherwise agreed upon. ![]() The agent is entitled to part of his commission when an option contract is signed and later falls through, that is, he is allowed to charge his fee percentage on the option contract funds kept by the owner as compensation for the failure of the buyer or seller to complete the sale. The reason behind that condition is that thanks to the agent, the owner has obtained those funds. PLEASE NOTE THAT REGARDING LAWS APPLYING TO BUYING OR SELLING REAL ESTATE, THE AGENT IS NOT A PROPER LAWYER AND IN MANY CASES MIGHT NOT BE AWARE OF NEW CHANGES. Although in my advertising the correct ENGLISH translation of "Gestor Profesional Intermediario" is something akin to "Intermediate Lawyer" as translated by the A.P.I. group - The Spanish Association of Real Estate Agents, as was PUBLISHED by the A.P.I. association in the Majorca Daily Bulletin around 1987 to describe the title of "Gestor Profesional Intermediario", and even though during two years we studied Spanish notarial law and real estate law as well as real estate marketing in the Malaga Politecnic Institute, it does not mean under ANY circumstances that we are "proper lawyers". We can advise and counsel on the ins and outs of buying and selling property or businesses here in Mallorca and also act as a legal intermediary, but we do NOT and CANNOT replace a proper lawyer. Our basic job is to find you the property that you want with the conditions that are more or less acceptable to you. AFTER that step, it is highly recommended that you consult with a proper lawyer to obtain up-to-date advice on the latest taxes, laws and ways most advantageous to you when making your purchase. The fees of the intermediary are NOT paid by you, but by the seller under current Spanish legislation OR unless agreed upon by all parties a different arrangement. ![]() IN THE CASE THAT YOU BUY A PROPERTY THROUGH TWO OR MORE AGENTS: Some buyers worry that,if, for example, you approach an agent who does not have the property you want, but HAS found the right property for you but through a different agent, that the purchase price will be higher due to the fees from the two agents. You can rest easy...that is NOT true. Agents, just like doctors and lawyers, when such situations arise, simply SHARE FEES, which of course does NOT increase WHATSOEVER the purchase price of the property in question. Proof of this is easy to check...have a friend contact the second agent and ask him the purchase price of said property. It should the the SAME price as offered to you through your agent. If not, please DO question him. It could be, and this happens to ALL agents VERY OFTEN, owners list their property with agent "A". The owner MIGHT think that agent "A" is not promoting it hard enough, so, after some weeks or months pass, the owner calls agent "B" and offers him the same property but at a LOWER price in hopes of selling it faster. In this case this is NOT the fault of the agent. In reality, the owner SHOULD ALWAYS contact the first and/or ALL agents he has it with, if he has any price or condition changes on the property. Worst thing in the world is to see the SAME property advertised at two different prices! Buyers should NOT automatically blame the AGENT. In my books, the CHEAPER the property is, the more chances I have of selling it. Increasing artificially the price is totally COUNTER PRODUCTIVE. At the end of the day, you will be dealing directly with the owner anyway, so any price discrepancies can be easily clarified then and there - and do not be afraid to openly ASK. In this way you/we avoid misunderstandings and bad feelings. Although the costs of a proper lawyer are paid for by the BUYER, it is definitely money well spent, and can only serve to further guarantee the correctness of your purchase and the peace of mind that comes with knowing all was done properly, correcly, legally and your purchase is secure. Such peace of mind has no price.
